Terms of service

Last updated October 27, 2026

spicy.fm hasn't opened yet. Until it does, anything this page sends to the Help center or a form on the site goes by email instead: support@spicy.fm for help and billing, and legal@spicy.fm for reports of illegal content.

These terms are the agreement between you and spicy.fm. spicy.fm is run by Spicy FM LLC, a limited liability company organized in Nevada, USA ("spicy.fm", "we", "us"). By creating an account, buying anything or simply using the site, you agree to them. If you don't agree, don't use spicy.fm.

Creators also agree to the Creator agreement, which adds to these terms. Our Privacy policy, Cookie policy, Community guidelines, Refund policy, Copyright and DMCA policy and Complaints policy are part of these terms too.

1. Who can use spicy.fm

spicy.fm hosts sexually explicit material and is only for adults.

  • You must be at least 18 years old, and old enough to view adult material where you live if the age there is higher.
  • You must be allowed to view adult material where you are. Using spicy.fm from a place where it is illegal is not allowed, and we block some countries and regions.
  • You can't use spicy.fm if we have closed your account before, or if you are barred from receiving our services under US or other sanctions laws.
  • Where the law asks us to check your age, we will ask you to pass an age check before you can see content.

By using spicy.fm you confirm that all of this is true.

2. Your account

  • Give us accurate information and keep your email address up to date. You must confirm your email address before you can pay, comment or become a creator.
  • One person, one account, unless we allow otherwise (for example, an agency's team members each have their own account).
  • Keep your sign-in details safe. Turn on two-factor authentication or use a passkey. You are responsible for what happens in your account until you tell us it was taken over.
  • Don't sell, rent or hand over your account.
  • You can delete your account at any time from your account settings. It closes at once and is deleted for good after 30 days, unless you sign back in before then. We keep some records after that, as the Privacy policy explains.

3. What spicy.fm is

spicy.fm is a platform. Creators publish their own content and set their own prices; fans subscribe to creators, buy single posts and messages, tip, join live shows and calls, and talk to creators directly.

Content on spicy.fm is made and owned by creators, not by us. We don't make, commission or endorse it, and the contract for each purchase is between you and the creator. We provide the service that makes that possible, collect payments on creators' behalf and pay them their share.

4. Paying for things

  • Prices are in US dollars. Sales tax or VAT is added on top where the law requires, and shown before you pay.
  • Payments are handled by our payment partners (for example CCBill or Segpay). Their terms also apply to the payment itself, and the charge shows on your statement under their name, not the creator's.
  • Subscriptions renew automatically at the end of each period, at the price you agreed to, until you turn renewal off. You can turn it off at any time under Subscriptions in your account; you keep access until the end of the period you paid for.
  • Tokens are prepaid credit on your spicy.fm balance that you can spend on tips, live shows and calls. Tokens are not money, have no cash value, can't be transferred or sold, and can only be used on spicy.fm.
  • What you buy is a licence to view the content on spicy.fm for your own personal, non-commercial use. It is not ownership of the content.
  • Refunds follow the Refund policy. If you think a charge is wrong, please write to us first: we can usually sort it out faster than your bank. Filing a chargeback for a purchase you made or allowed may lead us to close your account.
  • We may decline, hold or reverse a payment we believe is fraudulent, and may ask you to verify your identity before you can keep buying.

5. Your content

Anything you post, upload or send on spicy.fm (posts, messages, comments, live video, audio) is "your content".

  • You keep ownership of your content.
  • You give spicy.fm a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, transcode, watermark, display and distribute your content on spicy.fm and in our apps, and to use it to run, protect and improve the service. This licence ends when your content is deleted, except for copies we must keep for legal reasons, for backups for a limited time, and for content others have already bought (which stays available to them).
  • You promise that you own your content or have all the rights and permissions needed, and that everyone who appears in it is an adult who agreed to appear in it and to it being published on spicy.fm.
  • You are responsible for your content and for any claim that it breaks the law or someone else's rights.

6. Rules

Follow the Community guidelines. In short, you must not:

  • post, request or share any content involving anyone under 18, or anyone who looks under 18 in a sexual context;
  • post anyone who did not agree to be filmed or photographed, or to have the content shared;
  • post content showing or encouraging real violence, non-consensual acts, incest, bestiality, or anything illegal;
  • harass, threaten, blackmail, dox or impersonate anyone;
  • copy, record, download, screenshot or redistribute content you don't own, or help anyone else do so;
  • take payments, or ask for them, outside spicy.fm for anything you found or arranged here;
  • offer or ask for in-person sexual services, or anything that amounts to prostitution or human trafficking;
  • send spam, use bots or scrapers, or try to get around our security, age checks, blocks or limits;
  • use spicy.fm to break any law.

We report child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement.

7. Content removal and complaints

Anyone, with or without an account, can report content using the complaint form. We look at every report. Reports of content involving someone under 18, or intimate images shared without the consent of the person in them, are handled within 48 hours, as US law (including the TAKE IT DOWN Act) requires. Other reports are answered within 7 business days. The Complaints policy and the Copyright and DMCA policy explain how this works and how to appeal.

8. What we may do

To keep spicy.fm safe and legal, we may review content, refuse or remove content, limit features, hold payments or payouts, and suspend or close accounts that break these terms or that we reasonably believe put others, us or our payment partners at risk. When we act on your account we tell you why, unless the law or safety stops us, and you can ask us to review the decision.

9. Changes to spicy.fm and these terms

We keep improving spicy.fm, and we may add, change or remove features. We may update these terms. When a change matters, we post the new version on this page ahead of time, tell you in advance where we can, and may ask you to agree to it before you carry on. Earlier versions stay readable on this page.

10. Disclaimers

We work hard to keep spicy.fm running and safe, but we provide it "as is" and "as available". To the extent the law allows, we don't promise that it will always be available or free of errors, and we are not responsible for content creators or other users post, or for what they say or do.

11. Limits on our liability

To the extent the law allows, spicy.fm is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability to you for any claim about spicy.fm is limited to the greater of what you paid us in the 12 months before the claim and 100 US dollars. Nothing in these terms limits liability that can't be limited by law, or the rights you have as a consumer where you live.

12. Indemnity

If you break these terms or the law, or your content infringes someone's rights, and that leads to a claim against spicy.fm, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

13. Disputes

If you have a problem with spicy.fm, write to us first through the Help center and we'll try to fix it. These terms are governed by the laws of the State of Nevada, USA, and federal US law, without regard to conflict-of-law rules. Disputes go to the state or federal courts in Clark County, Nevada, unless the law where you live gives you the right to bring a claim in your own courts.

14. Other things

  • If part of these terms can't be enforced, the rest still applies.
  • If we don't enforce a part of these terms straight away, we can still enforce it later.
  • You can't transfer these terms to someone else. We may transfer them to a company that takes over spicy.fm.
  • These terms may be translated, but the English version is the one that counts.

15. Contact

Questions about these terms: use the Contact page, or write to legal@spicy.fm.
