Copyright and DMCA policy
spicy.fm hasn't opened yet. Until it does, anything this page sends to the Help center or a form on the site goes by email instead: support@spicy.fm for help and billing, and legal@spicy.fm for reports of illegal content.
spicy.fm respects creators' rights and expects everyone on spicy.fm to do the same. This policy explains how to report content that infringes your copyright, how to respond if your content was removed, and what we do about repeat infringers. It follows the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. 512.
If the content shows you without your consent, or shows someone under 18, pick that reason on the complaint form instead: those reports are handled within 48 hours.
Reporting infringement
The quickest way is the complaint form at spicy.fm/complaints/new: pick "It's my work (a copyright notice)" and add links to the content. You'll get a reference to check its progress. You can also send a written notice to our designated agent (below).
A notice must include:
- your physical or electronic signature, or that of someone authorized to act for the copyright owner;
- a description of the work you believe is infringed;
- the address (URL) of each item on spicy.fm you want removed;
- your name, address, telephone number and email address;
- a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner.
We remove or disable the content quickly after a valid notice, and tell the person who posted it. Sending a notice you know is false can make you liable for damages.
Leaks of spicy.fm content
Creators can report copies of their spicy.fm content posted elsewhere from the Leaks page in their creator tools. We send takedown notices to the sites hosting them on the creator's behalf.
Counter-notices
If your content was removed and you believe it was a mistake, or you have the right to post it, you can send a counter-notice from the notice we sent you, or in writing to our designated agent. It must include:
- your physical or electronic signature;
- what was removed and where it appeared before;
- a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal court for your district (or, if you are outside the US, any district where spicy.fm can be found), and that you will accept service of process from the person who sent the original notice.
We send the counter-notice to the person who reported the content. If they don't tell us within 10 to 14 business days that they have filed a court action, we may restore the content.
Repeat infringers
We close the accounts of people who repeatedly infringe others' copyrights.
